Appeal Process
Under Section 14 of the Professional fish Harvesters Act, any person whose certification is refused by the Board or who is dissatisfied with their certification level may request an appeal with the Appeal Board. A person who wishes to appeal a decision of the Board, shall forward a request to the Executive Director of the Board, stating the grounds for the appeal.
The appeal Board is comprised of three members, appointed by the Minister of Fisheries and Aquaculture. There are two fish harvester representatives, and an independent chairperson.
Appeals are conducted at least once per year in central locations throughout the province. Those harvesters who have requested an appeal are mailed an appeal information package, which includes the date and location of their appeal hearing and a copy the information used by the Board to determine their current certification status.
